By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. Our store is hosted on Shoper.pl. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Definitions:

1. Seller - HARIETS SPÓŁKA Z.O.O., headquartered in Warsaw at 58/3 Swarzewska Street, 01-821 Warsaw, with Tax Identification Number (NIP) 1133071778, National Business Registry Number (REGON) 523131556, registered in the National Court Register under the number: 0000991354.

2. Customer - a natural person or legal entity or organizational unit without legal personality, using the online store, including the person for whom an account has been created and who makes purchases through the website of the online store moissanit.pl, on the terms specified in these Regulations.

3. Goods, assortment - items offered within the store.

Terms of Use of the Store

 1. Consumers making purchases within the store are subject to the provisions of the Act of 30 May 2014 on consumer rights (Dz.U. z dnia 24.06.2014). 

2. Orders placed in the store are fulfilled only within the territory of the EU.

3. Seller's contact details under which the Customer can quickly and effectively contact the entrepreneur are provided below. The address for submitting complaints is indicated in §6 of the regulations.:

Order Placement

1. Utilizing the shop necessitates prior submission of essential details. Upon registration, the client is obliged to furnish personal information as prompted. Failure to provide indispensable data, i.e., information requisite for the seamless fulfillment of the agreement, renders the contract unattainable. More about cookies policy here.

2. Orders are placed by selecting the appropriate options available in the store. After completing the order, the Customer is informed about the costs of its transportation.

3. Payment for the goods can be made in one of the following ways:

a) traditional bank transfer,

b) using the services of external payment providers. The entity providing online payment processing for fast transfers is Autopay S.A. Supported types of payment cards: Visa, Visa Electron, Maestro, MasterCard, MasterCard Electronic.

c). The entity providing online payment services in the field of fast transfer payments is PayPro S.A.

d). The entity providing online payment services in the field of card payments is Paypro S.A.

4. Payment is considered as made:

a) in the case of a bank transfer - upon receipt of payment into the Seller's account,

b) in the case of payment via external payment providers' services (Autopay S.A.) - The order processing time is counted from the moment of obtaining a positive payment authorization.

c). If the Customer chooses the payment method by transfer, electronic payment or payment card, the order will be processed from the date of crediting the Seller's bank account.

5. The order is processed after the payment has been made and the order has been confirmed by the store. In the event that the payment system operator mentioned in paragraph 3 letter b) of this paragraph informs about its withdrawal or in any other way indicates any irregularities concerning the payment, the processing time does not start until the situation is clarified.

6. In the event that the order cannot be fulfilled for any reason, the Seller promptly informs the Customer about it. Within 48 hours, the Customer decides whether to order another item, wait for the obstacle preventing the fulfillment of the original order to be resolved, or withdraw from the contract. In case of the Customer's passive approach, the contract is terminated. If the contract is terminated, all amounts paid by the Customer are refunded promptly.

7. Order fulfillment is carried out within the timeframe indicated at the time of placing the order. The deadlines are specified in business days. This timeframe is provided upon the final acceptance of the order by the Customer.

8. In the case of individual orders for jewelry designs, made based on photos provided by the Customer and executed according to the art of jewelry making, the moissanit.pl store is not liable for the construction of such jewelry and reserves the right to refuse its repair in case of damage by the Customer. Additionally, with each such project, the Customer is always informed about any potential risks that may occur when using this type of jewelry, which the Customer fully assumes at their own risk.

Delivery

The order processing time is indicated next to the product. The processing time is calculated from the moment the payment is recorded. The shipping time for the order is the product processing time plus the delivery time.

Delivery is carried out by courier with proof of receipt, provided by one of the selected courier companies (DPD, DHL), and each shipment is insured.

Delivery time 4 working days.

The cost of delivery is provided before the Customer places the order.

In the event that the goods are returned to the Seller due to:

a) Providing incorrect address details,

b) Failure to collect the shipment by the Customer,

c) Any other reason attributable to the Customer The Seller reserves the right to charge the Customer with all costs associated with such a situation, especially the cost of sending the goods.

In case of detecting any irregularities in the condition of the shipment, especially its external damages, the Customer should draw up a protocol with the courier containing information regarding the irregularities in the condition of the shipment. If they are noticed after the delivery of the shipment, the Customer should notify the courier about it and demand the protocol to be drawn up. The Customer acknowledges that failure to comply with the above obligation may result in the refusal to recognize their claims for complaints directed to the Seller.

 Complaints and warranty

1. The seller is obligated to deliver items free from defects consistent with their description presented in the store. In case the sold goods may differ from those presented in the store, the seller informs about it.

2. Moissanite.de by Harites is a registered creator with the Warsaw Assay Office. Every item made of gold and silver weighing over 5g bears the hallmark of the Warsaw Assay Office, indicating the type of metal used, as well as our maker's mark.

3. The store www.moissanite.de provides a lifetime warranty for the moissanite stone based on the MOISSANIT.PL by HARIETS Certificate.

4. The warranty does not cover mechanical damage to the product.

5. The warranty does not cover custom rings.

6. Silver jewelry is subject to a natural oxidation process, which is not a product defect and is not eligible for complaint.

7. Gold-plated silver jewelry undergoes a natural process of wear due to usage, which is not considered a product defect and is not eligible for complaint.

8. Complaints should be submitted to the address kontakt@moissanite.de. Complaints are processed within 14 days from the date of receipt. The customer is informed about the resolution of the complaint via email.

Return policy

1. You are entitled to cancel this agreement within 14 days without providing any justification.

2. The deadline to withdraw from the agreement expires 14 days after the day on which you acquire possession of the goods or on which a third party other than the carrier and indicated by you acquires possession of the goods.

3. To exercise the right to withdraw from the agreement, you must inform the Seller via email at kontact@moissanit.pl.

 4. The return should be made via any courier company to the following address: Hariets Spólka Z.O.O. ul. Swarzewska 58/3, 01-821 Warsaw Poland. The buyer covers the cost of the return shipment.

5. In the event of withdrawal from this agreement, we will refund all payments received from you without undue delay, and in any case no later than 14 days from the day on which the product is returned to us along with the original receipt or VAT invoice.

6.The Seller will refund the payment using the same payment methods that were used by the Buyer in the original transaction, unless the Buyer agrees to a different solution, and in any case the Buyer will not incur any fees in connection with this refund.

Returns or exchanges apply to goods that:

a. show no signs of use;

b. have not been damaged in any way;

c. are in their original and undamaged packaging along with the Certificate.

Returns or exchanges do NOT apply to goods that:

a. for the provision of services if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the provision began that upon the completion of the service by the entrepreneur, they would lose the right to withdraw from the contract;

b. Custom jewelry

c. 14k Gold Jewelry

d. Engraved jewelry

e. Gold-plated jewelry

f. Custom-sized jewelry

For products that are not eligible for returns and exchanges, there is information stating that they are not eligible for returns and exchanges.

Personal data

The Seller declares that all personal data obtained within the online store are subject to protection.
